The will of Professor Robert Willis

Under the terms of his will, Robert Willis forgave his eldest son Robert Francis Willis his debts, and returned the life insurance policy on him. He also got his Father's watch. Margaret Elizabeth Besant (his daughter) got his alabaster ornaments and paperweights, and the other children each got one item of their choosing as a keepsake. All his manuscripts, plans, drawings, tracings and notes (i.e. his work) went to his nephew John Willis Clark (son of his sister Susanna), who later published them; he also got fifty books of his choosing and some Italian watercolours. Everything else was divided into seven portions. One seventh went in trust for Margaret Elizabeth Besant to receive the income; another seventh went in trust for his son Charles Whewell Willis to receive the income - he obviously wasn't trusted with it. The remaining five sevenths went one part each to the children Alan, Arthur, Robert Francis, Frederick (minus the £1000 he had been advances for farming purposes in New Zealand - he wasn't forgiven his debts!) and Edward Romilly. His mechanical models were left to the University of Cambridge.

This is the last Will and Testament of me The Reverend Robert Willis of Parkers Piece in the Town of Cambridge Clerk in Holy Orders Jacksonian Professor in the University of Cambridge. I give and bequeath unto my Son Robert Francis Willis my Watch and the Policy of Assurance on his life in the Law Life Insurance Office for Five hundred pounds together with all accumulations (if any) thereon And in consideration of the said Robert Francis Willis being my eldest son I forgive him (whether living or dead at my death or not and so that in the latter alternative such forgiveness shall ensure for the benefit of his estate) the principal sum of Four hundred and seventy-four pounds twelve shillings advanced to him by me together with all Interest that may be due thereon and also all other sums of money that he may owe me at the time of my decease I give and bequeath unto my daughter Margaret Elizabeth Besant the Wife of William Henry Besant Esquire the Alabaster Ornaments Figures and Paper weights purchased by me in Italy. I give and bequeath to each of my Children (other than the said Robert Francis Willis and Margaret Elizabeth Besant) any one article of Jewellery Plate Furniture or other household effects and ornaments not otherwise specifically devised which they may select as a memorial of me such children to have the preference in the choice of such articles according to priority of birth. I give and bequeath unto my Nephew John Willis Clark all my Manuscripts Plans Tracings Drawings and Notes and hereby declare that he shall be at liberty to publish such as the same as he may from time to time think fit And I also give and bequeath unto him such of my Books (not exceeding in the whole fifty volumes) as he may select and also the Views of Italian Scenery I give devise and bequeath all my Real estate and all the residue of my personal estate whatsoever and wheresoever which I may die possessed of or entitled to and which I may have any power to appoint or dispose of by this my Will Unto the said John Willis Clark and William Henry Besant (hereinafter called my Trustees) Upon trust to permit any parts of my personal estate invested in any Securities yielding Interest at my decease to continue in the same securities And subject to this discretion any power Upon trust to collect as soon as conveniently may be after my decease all sums of money due to me and to convert into money all such parts of my residuary personal estate as shall not consist of money or securities for money (subject however to the proviso hereinafter contained as to my Mechanical Models) and to invest the proceeds in some or one of the securities hereinafter authorised And to stand possessed of my residuary real and personal estate (hereinafter called my trust estate) Upon trust as to one equal seventh part thereof to pay the rents dividends and annual income arising therefrom as and when the same shall become due and payable unto my Daughter the said Margaret Elizabeth Besant during her life for her own sole and separate use and benefit free from the debts control and engagements of the present or any future husband and so that her receipt alone shall be sufficient discharges therefor but without power to anticipate charge or otherwise dispose of the same income or any part thereof And I empower her to appoint by her last Will all or any part of the said income to any husband who may survive her for his life or for any shorter period And subject to the life interests aforesaid I direct that the said one seventh share in my said trust estate and the future income thereof shall be held Upon such trusts for the benefit of all or any one or more of the Children of my said Daughter for such interests in such proportions and in such manner in all respects as my said Daughter shall by her last Will appoint And in default of such appointment and subject thereto Upon trust for the Child or Children equally if more than one of my said Daughter who either before or after the determination of the previous trusts shall being Sons attain the age of twenty one years or being Daughters attain that age or marry But no one Grandchild in whose favour an appointment shall be made under the power aforesaid shall without an express declaration to that effect participate in the unappointed portion of my trust estate without bringing the appointed share or interest into distribution And no appointment shall vest any interest in any Grandchild before majority or marriage And if there shall be no Child of my said Daughter who shall attain a vested interest as aforesaid Upon trust for such persons and for such interests as my said Daughter may by Will appoint And in default of appointment Upon the trusts hereinafter declared concerning the six remaining one seventh shares of my said trust estate And I hereby declare that the provision hereby made for my said Daughter shall be deemed and taken to be in addition to the provision I have already made for her by an Indenture bearing date the twenty fifth day of April One thousand eight hundred and seventy two And as to one other equal seventh part of my trust estate I direct my Trustees to stand seized and possessed thereof Upon trust to grant assign and transfer the same unto my said Son Robert Francis Willis And as to one other equal seventh part of my trust estate I direct my Trustees to stand seized and possessed thereof Upon trust to grant assign and transfer the same unto my son Frederick Willis And I declare that the sum of One thousand pounds which I have already advanced to my Son Frederick Willis for certain farming purposes in New Zealand shall be taken and considered as part of his share under this my Will and be accounted for accordingly And as to one other equal seventh part of my trust estate I direct my Trustees to stand seized and possessed thereof Upon trust to grant assign and transfer the same unto my son Edward Romilly Willis And as to one other equal seventh part of my trust estate I direct my Trustees to stand seized and possessed thereof Upon trust to grant assign and transfer the same unto my Son Arthur Willis And as to one other equal seventh part of my trust estate I direct my Trustees to stand seized and possessed thereof Upon trust to grant assign and transfer the same unto my Son Alan Willis And as to the remaining equal seventh part of my trust estate I direct my Trustees to stand seized and possessed thereof Upon trust to receive the rents dividends and annual income thereof and during the lifetime of my Son Charles Whewell Willis to pay and apply the same in such manner at such times and in such sums as the said Trustees or Trustee shall in their or his uncontrolled discretion think fit for the benefit of all or any one or more exclusively of the other or others of the persons following namely the said Charles Whewell Willis his Wife and Children for the time being And after the decease of the said Charles Whewell Willis my said Trustees shall pay the said rents dividends and annual income unto the Widow of the said Charles Whewell Willis during her life or until she shall marry again whichever event shall first happen she thereout maintaining and educating the children for the time being of the said Charles Whewell Willis And on the second marriage or decease of the Widow of the said Charles Whewell Willis whichever event shall first happen I direct my said Trustees to stand possessed of the said one equal seventh part of my trust estate Upon trust for the Child or Children equally if more than one of my said Son Charles Whewell Willis who either before or after the determination of the previous trusts shall being Sons attain the age of twenty one years or being Daughters attain that age or marry And if there shall be no Child of my said Son Charles Whewell Willis who shall attain a vested interest as aforesaid Upon the trusts hereinbefore declared concerning the remaining six equal seventh shares of my said trust estate Provided always that my Trustees shall not sell my Mechanical Models until they shall have offered the same unto the University of Cambridge by writing under their hands at a price to be fixed by the valuation of some competent Appraiser to be nominated and chosen by them But if at the expiration of three calendar months the said University shall not have accepted such offer the said Mechanical Models shall be sold in such manner as my Trustees may deem most advantageous Provided also that my said Trustees may after the death of the said Margaret Elizabeth Besant and William Henry Besant and Charles Whewell Willis and any Widow of his or in their lifetime with their his or her consent in writing raise any part or parts of the then expectant or presumptive or vested share of any Child of the said Margaret Elizabeth Besant and Charles Whewell Willis under the trusts hereinbefore declared and apply the same for his or her advancement or benefit And shall after the decease of the said Margaret Elizabeth Besant William Henry Besant and Charles Whewell Willis and after the decease or second marriage of any Widow of the said Charles Whewell Willis apply the whole or such part as my Trustees shall think fit of the annual income of the share to which any Child of the said Margaret Elizabeth Besant and Charles Whewell Willis shall be entitled in expectancy under the trusts hereinbefore declared for or towards the maintenance or education of such Child either directly or to his or her Guardians or Guardian without seeing to the application thereof or requiring any account of the same And shall during such suspense of absolute vesting accumulate the residue (if any) thereof in the way of Compound Interest by investing the same and the resulting income thereof in or upon any of the securities hereinafter authorised for the benefit of the person or persons who under the trusts hearing contained shall become entitled to the principal fund from which the same respectively shall have proceeded with power to resort to the accumulations of any preceding year or years and apply the same for or towards the maintenance or education of the Child for the time being presumptively entitled to the same respectively And I direct my Trustees to invest all monies requiring to be invested under the trusts of this my Will in the Parliamentary Stocks or Public Funds of Great Britain or of the United States of America or of any State or Province of the United States of America or at Interest on Government or Real or Leasehold Securities (having at least sixty years to run) in Great Britain or Ireland or on the security of the Debentures or Debenture Stock or Mortgages of any Company or Companies for the construction or working of any Railway or Railways Canal or Canals in Great Britain or Ireland or in the Provinces of Canada or in the United States of America or in any Colony of Great Britain with power to vary the said securities at their discretion And I empower my Trustees to sell my Real estate or any part or parts thereof as and when they shall deem the same expedient in such manner and subject to such conditions as to them shall seem fit And I also empower my Trustees to demise all or any part of my Real estate for any term of years not exceeding Twenty one years to take effect in possession so as there be reserved on every such demise the best yearly rent or rents that can be reasonably gotten without taking any fine or premium therefor And I hereby declare that the receipt or receipts of my Trustees for any monies stocks funds or securities paid or transferred to them in pursuance here of shall effectually discharge the person or persons paying or transferring the same therefrom and from being conceived to see to the application or nonapplication thereof And I hereby declare that the power of appointing a new Trustee or new Trustees of this my Will shall be exerciseable by the said Margaret Elizabeth Besant and Charles Whewell Willis during their joint lives and by the survivor of them during his or her life and after the decease of the survivor by the surviving or continuing Trustees or Trustee for the time being or the acting executors or executors administrators or administrator of the last surviving or continuing Trustee or by the last retiring Trustees or Trustee And upon any such appointment the number of Trustees may be augmented or reduced I devise all estates vested in me as Trustee or Mortgagee unto the said John Willis Clark and William Henry Besant Upon the trusts and subject to the equities affecting the same respectively And I appoint the said John Willis Clark and William Henry Besant Executors of this my Will In witness whereof I have hereunto set my hand this eleventh day of May in the year of Our Lord One thousand eight hundred and seventy two - Robt Willis
