The Will of Ann Child Willis
Ann Child, wife of Admiral Willis, left some property in Beverley to her son Richard Child Willis, but he was not allowed to sell it without permission of the trustees (William Hiscox of Brighton, William Edward Woodall of Scarborough, and Henry John Shepherd of Beverley). £4000 of 3% consols were to go to Revd Robert Willis of Cambridge, and £200 per annum of the income from the remaining consols was to be paid to her daughter in law Frances. The remaining income was to go to her son, but the consols themselves were left to any grandchildren that he might produce; if he didn't, it was half to each of her nephews John and William Hiscox. Her son was the residuary legatee.
This is the last Will and Testament of me Ann Willis of Petworth in the County of Sussex Widow I give and devise my freehold messuage or dwelling house situated in Beverley (in Wednesday Market Place) in the County of York with the outbuildings yard Gardens and appurts thereunto belonging and also my several Cottages with the yard and Garden adjoining the said messuage and premises unto and to the use of my dear son the Revd Richard Child Willis his heirs and Assigns for ever but in case my son should be desirous of selling the said messuage Cottages Gardens and Premises or any of them I do direct that no sale or contract for sale or conveyance thereof shall be of any validity or effect without the previous consent in writing of my trustees hereinafter named or of the survivors or survivor of them or the executors or admors of such survivor I give and bequeath unto my trustees and executors William Hiscox of Brighton in the County of Sussex Gentleman John Woodall Senior of Scarborough in the County of York Gentleman and Henry John Shepherd of Beverley aforesaid Gentleman the legacy of one thousand pounds equally to be divided between and amongst them and I direct the same to be paid to or obtained by them at the expiration of twelve Calendar months (or sooner if possible) next after my decease I give and bequeath all my Capital stock in the three per Cent consols the three per Cent ? And the long annuities now standing in my name (Ann Willis Widow of Rear Admiral Willis Petworth) unto the said William Hiscox John Woodall and Henry John Shepherd upon trust to transfer immediately after my decease four thousand pounds three percent consols (to be exonerated from legacy duty) unto the Revd Robert Willis of Cambridge and upon trust to cause the remainder of my said Capital stock to be transferred into their own names and to stand possessed thereof in trust to pay the Clear Yearly Sum of two hundred pounds out of the dividends to be received from the said Capital stock into the hands of my daughter in law Frances Willis the wife of the said Richard Child Willis during her natural life or until she shall marry again for her sole and separate use her receipt alone to be a sufficient discharge for the same and in trust to pay the remainder of the said dividends as they shall from time to time be received unto my said dear son Richard Child Willis during his natural life and from and immediately after his decease upon trust to stand possessed of the remainder of my Capital stock in trust for all and every the child and children of my dear son Richard Child Willis in equal shares and proportions if more than one and if but one then in trust for ? ? and to be paid or transferred to him her or them when such child or children attain the age of twenty one years and I direct that the shares of any of my Grandchildren dying in their minority shall go to my surviving Grandchildren in equal proportions and that of the dividends (subject to the payment of the said yearly sum of two hundred pounds to the said Frances Willis) or so much of their of as my said trustees shall in their discretion deem necessary shall be applied in or towards the maintenance and education of my Grandchildren during their respective minorities and in case my said son shall depart this life leaving no lawful issue surviving him and from and immediately after the decease of the said Richard Child Willis upon further trust to sell and transfer so much of my Capital stock as shall be necessary to raise and produce the sum of one thousand pounds sterling which I direct to be paid in case of my sons death without lawful issue unto the three sons of the late Revd Thomas Willis Doctor of Laws for their use and benefit equally to be divided between and amongst them and in trust to stand possessed of one equal moiety or half part of the said Capital stock (subject to the payment of one equal moiety or half part of the said Annuity to the said Frances Willis) in trust for my nephew the said William Hiscox his Executors Admors and assigns and to stand possessed of the other moiety or half part their of subject as aforesaid in trust for all and every the lawful child and children of my nephew John Hiscox to be paid to them when as they respectively attain the age of twenty-one years all the residue of my personal estate I give and bequeath unto the said William Hiscox John Woodall and Henry John Shepherd upon trust to convert the same into money and their out to discharge all my just debts and funeral and testamentary expenses to pay over the surplus to my said dear son Richard Child Willis his Executors Admors and Assigns and I appoint the said William Hiscox John Woodall and Henry John Shepherd joint Executors of this my will upon the trusts aforesaid In Witness whereof I have hereunto set my hand and seal this first day of August in the year of our Lord one thousand eight hundred and thirty-three – Ann Willis – Signed sealed and published and declared by Ann Willis the testatrix as and for her last will and testament in the presence of us who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses - Jn Myers of Beverley Attorney at law Gilbt Bolden of Beverley Gent Sarah tribe servant to the said Ann Willis
Whereas I Ann Willis of Petworth in the County of Sussex Widow on or about the first day of August one thousand eight hundred and thirty-three duly made and published duplicates of my last will and testament in writing I gave and bequeathed unto my trustees and executors William Hiscox of Brighton in the County of Sussex Gentleman John Woodall the elder of Scarborough in the County of York Gentleman and Henry John Shepherd of Beverley in the County of York gentleman the legacy or sum of one thousand pounds equally to be divided between and amongst them and I did direct the said to be paid to or obtained by them at the expiration of twelve Calendar months (or sooner if possible) next after my decease and after making other bequests as in my said will mentioned I appointed the said William Hiscox John Woodall and Henry John Shepherd joint executors of that my will upon the trusts therein mentioned and whereas the said John Woodall is desirous of being discharged from every Clause Matter and Thing in any case relating to my said will and the trusts thereof now therefore I the said Ann Willis do hear by revoke the bequests above-mentioned so far only as related to the said John Woodall and also the appointment of the said John Woodall as a joint executor in trust of my said will and I do hereby give and bequeath unto William Edward Woodall of Scarborough aforesaid Gentleman the share or proportion of the said sum of one thousand pounds by my said will given and bequeathed to the said John Woodall as aforesaid as fully and effectually to all interests and purposes as if the said William Edward Woodall had been originally named in my said will as the person entitled to receive the same I do hereby nominate constitute and appoint him joint executor in trust of my said will together with the said William Hiscox and Henry John Shepherd (in the place and stead of the said John Woodall so desirous of being discharged as aforesaid) and do hereby empowered him the said William Edward Woodall to so perform all such acts deeds matters and things and to accept such legacy or benefit under my said will as a therein is mentioned to be performed by and bequeath to my said trustees and executors therein appointed and lastly I do declare this present writing to be eight Codicil to my said Will and that the same shall be annexed thereto taken as part of their of and to ratify I confirm my said will in every particular of that is not hereby altered all revoked In Witness whereof I have to this my first Codicil and also to a duplicate thereof set my hand and seal the second day of October one thousand eight hundred and thirty three - Ann Willis - Signed sealed published and declared by the said Ann Willis as and for a first Codicil to be annexed to and taken as part of her said will in the presence of us who in her presence at her request And in the presence of each other have hereunto subscribed our names as witnesses Edwd S Donner - Isaac Walshaw - Jno Chambers
Proved at London with a Codicil 25th May 1835 before the Worshipful William Robinson Dr of Laws and Surrogate by the Oaths of William Hiscox the nephew and Henry John Shepherd the exors named in the will and William Edward Woodall the exor named in the Codicil to whom admon was granted been first sworn duly to admr.
