IN THE NAME OF GOD AMEN I the Reverend Rowland Grove Curtois of the City of Rochester Doctor in Divinity Chaplain to her Majesty's fforces do hereby revoke all Wills Codicils and Testamentary dispositions by me at any time heretofore made and declare this to be my last will and testament I give and bequeath unto my dear wife Mary Curtois all the ready money which shall be in my dwelling house or in the hands of my Bankers or Agents and all rents and dividends which may be due to me at the time of my decease subject nevertheless to the payment therout of all my just debts except debts due on mortgage or bond and also my funeral and testamentary expenses and the expenses of proving this my will. I give and bequeath unto my said wife all my household furniture linen china glass wines provisions carriages and horses together with a portrait of the late Robert ffarquson Esquire and a silver tankard niacted(?) with the crest of the ffarquson ffamily for her absolute use and also give and bequeath to my said wife the use and enjoyment of all my plate books pictures and prints (except the said portrait and tankard) during her life And after her decease I give and bequeath the same use unto and equally between my two sons and their respective heirs executors and administrators I give and devise all that my farm and estate called Bell ? ffarm situate in the parish of Hoo in the County Kent and now in the tenancy or occupation of John Pearce the elder and also that my orchard called ? Orchard in the parish of Gillingham in the said County of Kent unto my son George Charles Widdrington Curtois his heirs and assigns for ever suject nevertheless to the several mortgage annuities affecting the same and to the principal sums of three thousand seven hundred and thirty three pounds and fifteen shillings and eight hundred and twenty eight pounds and interest thereby secured And also subject to the payment of the sum of one thousand and sixty four pounds twelve shillings borrowed by me of the Trustees of the Will of Sir General David Latimer Tinling Widdrington deceased towards payment of the purchase money for the said estate called The Bell ? ffarm and which said sums of three thousand seven hundred and thirty three pounds and fifteen shillings and eight hundred and twenty eight pounds and one thousand and sixty four pounds twelve shillings shall be exclusively charged upon the hereditaments hereinbefore in exoneration of my other real estate and of my personal Estate I also give and bequeath unto my said son George Charles Widdrington Curtois the sum of five hundred pounds I give and devise all those my freehold messuages(?) lands and heridataments in the Parish of Hibbrook in the County of Lincoln and now in the occupation of William Houlton unto my son Rowland Latimer Sidney Curtois his heirs and assigns and as to all the rest residue and remainder of my property estate and effects whatsoever and wherever I give devise and bequeath the same unto and equally to be divided between my said sons as tenants in common Provided always and I do hereby declare that in case eiher of my said sons shall be under the age of twenty one years at the time of my decease then I direct and declare that during their respective minorities it shall be lawful for the executor or executors for the time being of this my will to let from year to year or for any term not exceeding twenty one years in possession at the best rent and manage the said freehold hereditaments hereinbefore devised and receive the rents and profits thereof and after payment of the incidental outgoings and expenses my said executors or executor do and shall apply the said rents and profits or an adequate part thereof in the maintenance and education of my said sons and invest the unapplied surplus upon the Government or real securities and improve the same as an accumulating fund varying the investment from time to time as may be thought proper but with liberty to apply the income and if seemed neccesary the capital also of the same fund for the preferment and advancement in life of my said sons respectively and in the event of my said sons respectively attaining the age of twenty one years the same fund or so much thereof as shall remain unapplied for the purposes aforesaid shall be thereupon paid and transferred to them respectively for their respective absolute use and benefit And in the case of the decase of either of my said children under the age of twenty one years and without leaving lawful issue heirs surviving all and similar the devises and bequests hereinbefore made by me in favour of such son so dying shall go to the survivor of my said sons his heirs executors and administrators and in case of the decease of both my said sons without having attained the age of twenty one years and without leaving such lawful issue as aforesaid then I give devise and bequeath all my said property estate and effects hereinbefore given devised and bequeathed as aforesaid unto my executors hereinafter named and the survivors and survivor of them his heirs executors and administrators upon trust to permit and suffer my said wife Mary Curtois to receive and take the ? interest dividends and annual profits thereof for her sole use and benefit for and during the term of her natural life and after her decease for all and every the children and child of my brother Peregrine Samuel Curtois of Langrickville near Boston in the County of Lincoln Esquire who shall be living at the decease of my said wife equally to be divided between them as tenants in common And I appoint my said wife Mary Curtois the Reverend Sidney Henry Widdrington of the City of Bath ? Adolphus Latimer Widdrington a Captain in her Majestys 73rd Regiment of ffoot and George Murray late of the City of Chichester Esquire as EXECUTORS of this my will and Guardians of my children during their respective minorities In witness thereof I the said Rowland Grove Curtois the testatrix have hereunto set my hand the thirty first day of May one thousand eight hundred and forty three - R. This is a codicil to the last Will and Testament of me The Reverend Rowland Grove Curtois of the City of Rochester Doctor in Divinity which will bears date the thirty first day of May one thousand eight hundred and forty three whereas since the date and execution of my said will I have purchased of the Trustees of the Will of Thomas Carpenter late of Hoo in the County of Kent Gentleman deceased several pieces of land situate in the Parish of Saint Warburgh otherwise Hoo adjoining my estate called Bell ? and containing together about twenty four acres more or less and the same have been ? conveyed to me by the said trustees now I do hereby give devise and bequeath the said several pieces of land unto my son George Charles Widdrington Curtois his heirs and assigns subject nevertheless to and charged and chargeable with the payment of the sum of nine hundred pounds borrowed by me of the trustees of General David Latimer Tinling Widdrington to enable me to pay for the same and also to the payment of the sums of three thousand seven hundred and thirty three pounds fifteen shillings and eight pence and one thousand and sixty four pounds twelve shillings in my said will mentioned and the interest thereof respectively in exoneration of my personal estate and in all other respects I confirm my said Will In Witness whereof I have hereunto set my hand this eighteenth day of December one thousand eight hundred and forty four - R. This is a further codicil to the last Will and Testament of me The Reverend Rowland Grove Curtois of the City of Rochester Doctor in Divinity bearing date the thirty first day of May one thousand eight hundred and forty three I revoke the appointment thereby made of Adolphus Latimer Widdrington as one of my executors by reason of the delicate state of his health and in his place I appoint Stephen Jennings Swayne of the City of Rochester Doctor of Medecine to be an executor of my said Wills and Codicils and Guardian of my children in conjunction with my wife and the Reverend Sidney Henry Widdrington and George Murray the other executors named in my said will and I give and grant unto the said Stephen Jennings Swayne all such and the same powers and authorities as are given to and vested in my said other executors named in my said will and in all other respects I confirm my said Will and the former codicils thereto dated respectively the eighteenth day of December one thousand eight hundred and forty four and twelfth day of April one thousand eight hundred and forty five In Witness whereof I the said Rowland Grove Curtois the testator have hereunto set my hand the twenty seventh day of May one thousand eight hundred and forty six - R. This is a further codicil to the last Will and Testament of me The Reverend Rowland Grove Curtois of the City of Rochester Doctor in Divinity which will bears date the fourth day of January one thousand eight hundred and forty nine I give and bequeath to my youngest son Rowland Latimer Sidney Curtois in trust the sum of three hundred pounds now on bond to the trustees of the Marlborough College for ten years at five per cent per annum in addition to any sum or sums herein bequeathed to him by me And I direct my said trustees to apply the dividends and income of the said three hundred pounds towards the maintenance and education of my said youngest son Rowland Latimer Sidney Curtois In Witness whereof I have hereunto set my hand this fourth day of January one thousand eight hundred and forty nine - R. APPEARED PERSONALLY Mary Curtois of the City of Rochester Widow the relict and one of the executors of the last Will and Testament with three codicils thereto of the said Reverend Rowland Grove Curtois late of the City of Rochester aforesaid Doctor in Divinty deceased and referring herself to the second codicil to that said will bearing date the twenty seventh day of May one thousand eight hundred and forty six and in particular to the clause following to wit - "And in all other respects I confirm my said Will and the former codicils thereto dated respectively the eighteenth day of December one thousand eight hundred and forty four and twelfth day of April one thousand eight hundred and forty five" made oath that on a day happening in the week next preceding the death of the said Testator ? the Testator produced to the deponent the Codicil to his last Will and Testament so referred to bearing date the twelfth day of April one thousand eight hundred and forty five and desired the deponent to read over the same to him which the deponent did accordingly whereupon the deceased the deponent being alone with him declared his intention of cancelling the said Codicil and immediately cancelled the same by throwing it into the fire whereby the said codicil bearing date the twelfth day of April one thousand eight hundred and forty five was actively consumed And she further made oath that the said deceased was at such time was of sound mind memory and understanding and that she knows not of any other Codicil to the Will of the said deceased bearing the said date of the twelfth day of April one thousand eight hundred and forty five - Mary Curtois - On the twenty first day of March 1849 the said Mary Curtois was duly sworn to the truth of his Affidavit Before me [illegible]

APPEARED PERSONALLY Stephen Jennings Swayne of the City of Rochester Esquire Doctor in Medicine and made oath that he is one of the executors named in the second Codicil of the last Will and Testament with three Codicils of The Reverend Rowland Grove Curtois late of the City of Rochester aforesaid Doctor in Divinity deceased and referring himself to the third of the said Codicils the same being hereunto annexed beginning thus "This is a further codicil to the last Will and Testament of me The Reverend Rowland Grove Curtois of the City of Rochester Doctor in Divinity" ending thus "In Witness whereof I have hereunto set my hand this fourth day of January one thousand eight hundred and forty nine" and thus subscribed "R. G. Curtois" further made oath that he was well acquainted with the said deceased and attended him as his Medical Advisor during the illness which terminated by his death and being in attendance on the said deceased on the fourth day of January one thousand eight hundred and forty nine the said deceased expressed to him a desire to make an addition to his will by bequeathing to his youngest son Rowland Latimer Sidney Curtois a certain sum of three hundred pounds and requested the deponent to draw up a Codicil to such effect whereupon the deponent under such the verbal instructions of the said deceased drew up without making any draft thereof the very Codicil ? as aforesaid and now hereto annexed And referring himself to the said Codicil and Clause therein which purports to write the date of the last Will and Testament of the said deceased in the words following to wit "which will bears date the fourth day of January one thousand eight hundred and forty nine" the deponent further made oath that being inexperienced in the preparation of papers of a legal or testamentary nature he thro' error and by mistake wrote the word "Will" in the said ? Clause instead "Codicil" and that the said ? date of the fourth day of January one thousand eight hundred and forty nine was meant and intended by him the deponent to apply to the date of the said Codicil and was not meant or intended as the ? of the date of the last Will and Testament of the said deceased And the deponent further made oath that he was not at such time acquainted with date either of the last Will and Testament of the said deceased or of any Codicil thereto nor was he informed thereof by the said deceased nor was the last Will and Testament of the said deceased or any Codicils thereto produced or shown to the deponent but he the deponent knew only by casual mention thereof by the said deceased that he the deceased had already made with Codicils - Ste. J. Swayne - On the twenty first day of March 1849 the said Stephen Jennings Swayne was duly sworn to the truth of his Affidavit Before me [illegible]
PROVED at London with three Codicils 28th March 1849 before the Worshipful James Parker Deane Doctor of Laws and Surrogate by the oaths of Mary Curtois Widow the relict and the Reverend Sidney Henry Widdrington clerk two of the executors named in the Will and Stephen Jennings Swayne Esquire Doctor of Medicine the Executor named in the second Codicil to whom ? was granted having been first sworn duly to administer power reserved of making the life Grant to George Murray Esquire the ? executor named in the Will when he shall apply for the same.
